By accessing and using CakeCraft AI ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

CakeCraft AI is a B2B software-as-a-service (SaaS) platform that provides professional design tools for bakeries and cake artists:

• AI-powered design tool software for creating cake designs
• Professional recipe generation and cost calculation tools
• Design editing and HD export capabilities (4K quality)
• Recipe download and sharing features
• Business tools for bakeries and pastry shops

Our software generates cake and dessert design images (food photography) only. We do not generate human faces, likenesses, deep fakes, or any prohibited content.

3. User Accounts

To access our Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

4. Subscription Plans and Billing

CakeCraft AI offers three subscription tiers for professional bakeries:

• Starter: $9/month or $90/year - 20 design renders per month
• Professional: $19/month or $190/year - 100 design renders per month
• Business: $49/month or $490/year - Unlimited design renders

All subscriptions automatically renew unless cancelled. You will be charged the subscription fee at the beginning of each billing period. Payment processing is handled securely by Lemon Squeezy.

5. Free Trials

New subscribers receive a free trial period (7-30 days depending on plan). You will not be charged until the trial period ends. You may cancel anytime during the trial without charge.

6. Refund Policy

We offer a 7-day money-back guarantee for new subscriptions. To request a refund, contact us at support@cakecraftai.com within 7 days of your first payment. Annual subscriptions receive prorated refunds if cancelled within 30 days. See our full Refund Policy for details.

7. Content Ownership and Intellectual Property

User-Generated Content

All cake designs, recipes, and baking instructions generated through CakeCraft AI are owned by the subscriber. You retain full ownership and all rights to content created using our software tool.

Commercial Rights

Subscribers have full commercial rights to use, modify, and distribute their generated designs for business purposes. This includes selling cakes based on the designs, using designs in marketing materials, and sharing designs with clients.

Content Generation Restrictions

Our AI is programmed to generate food and cake images only. Generation of human faces, likenesses, deep fakes, or prohibited content is strictly forbidden and will result in immediate account termination.

Software Tool Clarification

CakeCraft AI is a software tool that assists bakeries in creating cake designs. It does not provide human services, consulting, or design services performed by humans. All designs are generated by AI algorithms.

Our Platform Rights

The CakeCraft AI platform, software, branding, and proprietary algorithms are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer our software.

AI Services

Designs are generated using our proprietary fine-tuned image generation model, and recipes using advanced AI language models. You are responsible for ensuring your use complies with applicable laws and regulations.

8. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Generate offensive, harmful, or inappropriate content
• Attempt to circumvent usage limits or access controls
• Resell or redistribute our Service without authorization
• Reverse engineer or copy our software

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

10. Limitation of Liability

CakeCraft AI is provided "as is" without warranties. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Issues arising from third-party services (OpenAI, payment processors)
• User-generated content or its commercial use

Our maximum liability is limited to the amount you paid in the last 12 months.

11. Cancellation

You may cancel your subscription anytime from your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds for partial months except as stated in our Refund Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Morocco. Disputes will be resolved in Moroccan courts or through binding arbitration.
